Welcome to Shop of Old. By accessing this website, purchasing from our collection, or claiming items through Instagram, live sales, or direct message, you agree to the following Terms and Conditions.
General Conditions
Shop of Old offers a curated collection of antique and vintage goods sourced from estates. Each piece is previously owned and one of one.
We reserve the right to refuse service to anyone for any reason at any time.
Prices, availability, product descriptions, and policies are subject to change without notice.
Inventory is limited and may change at any time.
Product Representation & Condition
All items are sold as described and photographed.
Due to the nature of antique and vintage goods, pieces may display signs of age, wear, patina, repairs, imperfections, and prior use. These characteristics are part of each item's history and are not considered defects.
We make every reasonable effort to accurately represent each item; however, colors, tones, and appearance may vary due to lighting, photography, and individual screen settings.
By completing a purchase, you acknowledge that you have reviewed the listing and accept the item's condition as presented.
All Sales Final
All items are sold as-is, and all sales are final.
We do not accept returns, exchanges, cancellations, or refunds due to buyer's remorse, failure to review photographs or descriptions, change of mind, or personal preference.
Nothing in this policy limits any rights that cannot legally be waived under applicable law.
Instagram, Live Sale & Direct Message Purchases
Items claimed through Instagram comments, direct messages, stories, or live sales constitute a binding purchase agreement.
Instructions for live sales will be provided at the beginning of each event. Buyers joining after the sale has begun are responsible for understanding the sale process before participating.
To claim an item during a live sale, comment the price shown unless otherwise instructed.
The first clear and valid claim, as determined by Shop of Old, will be recognized as the purchaser.
In the event of simultaneous or disputed claims, Shop of Old reserves the sole right to determine the final purchaser in the interest of fairness.
Once an item has been claimed, it is considered sold.
Invoices & Payment
Following a successful claim, buyers must provide their name and contact information so an invoice may be issued.
Payment in full is required within 24 hours unless otherwise agreed to in writing.
Invoices may include shipping at the time they are issued. For oversized, unusually fragile, or specialty shipments, shipping may be invoiced separately after packing.
Unpaid invoices may be canceled at our discretion, and the item may be offered to another buyer or returned to inventory.
Shop of Old reserves the right to:
- Refuse future transactions
- Restrict participation in future Instagram or live sales
- Cancel or refuse any order at our discretion
Repeated non-payment, abandoned invoices, or withdrawn claims may result in permanent removal from future sales.
Holds & Reservations
Because every item is unique, we do not place items on hold without payment or a non-refundable deposit.
Questions, conversations, or expressions of interest do not reserve an item.
Items remain available until purchased.
Shipping & Restrictions
Shop of Old ships exclusively within the United States.
International shipping is not available.
Orders placed using non-U.S. shipping addresses may be canceled at our discretion.
Buyers are responsible for providing a complete and accurate U.S. shipping address.
Shipping carriers are selected at our discretion based on the item's size, weight, destination, and packing requirements.
Third-Party Shipping Services
If a buyer chooses to use a freight forwarder, package forwarding company, reshipping service, or other third-party shipping provider, Shop of Old's responsibility ends once the package has been successfully delivered to the U.S. address provided during checkout.
Any damage, loss, delays, or issues occurring after delivery to that address are the sole responsibility of the third-party shipping service.
Shipping Insurance, Damage & Claims
All shipments include shipping insurance as outlined in our Shipping Policy.
Once a package has been transferred to the shipping carrier, any loss or damage is subject to the carrier's investigation and insurance process.
Should damage or loss occur during transit, Shop of Old will assist the buyer by handling the insurance claim directly whenever applicable. Buyers agree to provide all photographs, packaging materials, and documentation required to complete the claim.
Failure to provide the requested documentation or to report damage within the timeframe outlined in our Shipping Policy may result in denial of the insurance claim.
Refunds, when applicable, will be issued only after the carrier has completed its investigation and approved reimbursement.
Chargebacks & Payment Disputes
By completing a purchase, you acknowledge that you have reviewed and accepted the listing description, photographs, Shipping Policy, Refund Policy, and these Terms of Service.
Chargebacks or payment disputes initiated without first contacting Shop of Old may be contested using available documentation, including but not limited to:
- Listing descriptions
- Product photographs
- Invoice records
- Order history
- Tracking information
- Delivery confirmation
- Correspondence related to the transaction
Fraudulent or unwarranted chargebacks may result in refusal of future service and may be reported to payment processors when appropriate.
Limitation of Liability
To the fullest extent permitted by applicable law, Shop of Old shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the purchase, ownership, or use of any item.
In all circumstances, Shop of Old's maximum liability shall not exceed the purchase price actually paid for the item giving rise to the claim.
Intellectual Property
All content appearing on this website, including but not limited to text, photographs, graphics, branding, logos, product descriptions, and website design, is the exclusive property of Shop of Old and may not be copied, reproduced, distributed, or used without prior written permission.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles.
Changes to These Terms
Shop of Old reserves the right to modify or update these Terms and Conditions at any time without prior notice.
Any changes become effective immediately upon publication on this website.
Continued use of this website or completion of a purchase after changes have been posted constitutes acceptance of the revised Terms.
